Terms of sale

Peak Fish Co. · Serving Denver and surrounding areas.

These terms	Apply to every order unless we agree otherwise in writing.
Contracting party	Peak Fish, LLC, trading as Peak Fish Co.
Who we sell to	Trade only — restaurants, markets, grocers and other food businesses.
Payment	Terms are set per account and confirmed in writing when the account is opened. An account with an overdue invoice may be paused until it is settled.
Delivery	Denver and surrounding areas, on scheduled routes. The arrival date is posted with each week. Outside the area by arrangement. Product travels by air, so weather, a cancelled flight or a short landing can delay or reduce a delivery; we tell you as soon as we know.
Ordering	Orders are placed on the Live List while the week is open. Each item closes at its own time, shown on the item. Once an item or the week has closed it cannot be ordered for that delivery. It is on the next week's list.
Changes	An order can be changed on the Live List until the week's cutoff. After the cutoff, call us. A change is possible only until the order has gone to the boat; product is packed and flown to order, so once it is on the plane the order stands.
Quantities	Product arrives in fixed packs, so orders are filled in whole packs. If less lands than was ordered, you are billed for what was supplied, and the confirmation shows both figures.
Title and risk	Pass on delivery at your premises.
Liability	Our responsibility for any order is limited to the value of what was supplied on it. We are not responsible for losses that follow from a late or short delivery.
Prices	Quoted per account and confirmed on the order.
Accounts	Opened on a call. Nothing on this site creates one.
Governing law	Colorado. Any dispute is heard in Denver.
